Exemptions for Residential Developments


Housing Authority of the County of Stanislaus


  • Qualifications: Any Low or Very Low Income housing units constructed by the Housing Authority of the County of Stanislaus, or any entity in which the Housing authority is a major partner.
  • Conditions: Exemption granted at Building Permit issuance.

Low or Very Low Income or Special Needs Housing


  • Qualifications: Any construction or expansion of Low or Very Low Income housing units constructed by any person or entity (excluding the Housing Authority of the County of Stanislaus).
  • Conditions: The homebuyer would be required to sign a CFF Exemption Agreement, Promissory Note, and City Trust Deed. Upon City Council approval, the homebuyer would be granted a full CFF exemption provided there is not a resale or refinance for 10 years. If a resale or refinance should occur within the 10 year period, the full CFF exemption would be due, with no interest thereon.

Alterations or Additions to Residential Structures


  • Qualifications: Any alterations or additions to a residential structure shall be exempt from CFF, provided there are no additional dwelling units are being created.
  • Conditions: Exemption granted at building permit issuance. If new dwelling units are created, CFF may be due.

Newly Created Single-Family Developments After Demolition


  • Qualifications: Any replacement or reconstruction of a residential structure that has been destroyed or demolished, provided there are no additional dwelling units are being created.
  • Conditions: Exemption granted at building permit issuance. If new dwelling units are created, CFF may be due.

Newly Created Multi-Family Developments After Demolition


  • Qualifications: Any replacement or reconstruction of any multi-family residential structure that has been destroyed or demolished, provided all conditions are met.
  • Conditions: The square footage and number of residential units of the rebuilt structure must be equal to or less than the destroyed or demolished structure. If either of these conditions is not met, CFF may be due.

Replacement of Structures Due to Eminent Domain


  • Qualifications: Any replacement of an existing residential or non-residential structure that has been or will be vacated due to eminent domain proceedings, or the threat of such proceedings.
  • Conditions: Building Permit for the replacement structure must be applied for within 2 years after the transfer of title or within 2 years after the property has been vacated. Exemption would not apply to a residential structure where additional units are created or to a non-residential structure if there is to be additional square footage, the use is devoted to a higher density category, or results in the generation of additional peak hour trip ends.

Exemptions for Non-Residential Developments


Canopied & Enclosed Truck Loading Bays


  • Qualifications: CFF is not charged for canopied and enclosed truck loading areas provided that they are not used for the storage and/or protection of products.
  • Conditions: No application is needed. The CFF for canopied and enclosed truck loading bays is waived at building permit issuance.

Parking Garages


  • Qualifications: CFF is not charged for public parking garages.
  • Conditions: No application is needed. The CFF for parking garages is waived at building permit issuance.

Restaurant Outdoor Dining Patios


  • Qualifications: CFF is not charged for outside patio dining areas that are not enclosed.
  • Conditions: No application is needed. The CFF for unenclosed outside patio dining areas is waived at building permit issuance.

Rebuilding of Destroyed or Demolished Structures


  • Qualifications: CFF is not charged for the rebuilding or destroyed or demolished structures if the square footage of the rebuilt structure is equal to or less than the square footage of the destroyed or demolished structure and the building use of the rebuilt structure is the same as the destroyed or demolished structure. If the square footage increases and the use remains the same, then CFF shall be paid on only the incremental square footage increase.
  • Conditions: No application is needed. If all qualifications are met, then the CFF for rebuilt structures is waived at building permit issuance.
